Lo and behold, 2wire s media subscription service is Blockbuster

The beginning of Blockbuster Video s convergence into the service it needs to be to survive in this evolving video market, has finally begun this morning with the announcement of its streaming media system and its player of choice.

Add to your growing list of Questions People Forgot to Ask, the one where DVR and streaming media device manufacturer 2wire is asked who, exactly, it expects to provide streaming media for that device. Two weeks ago, 2wire premiered its MediaPoint device, with the promise of providing a fully-converged experience of Internet video and local media on the television.

With a 2wire board member having just joined ATT as its new CTO , there was some speculation that MediaPoint may become a delivery vehicle for ATT s U-verse fiberoptic service. And with 2wire already supplying U-Verse with gateway equipment, there was some presumption that ATT would play into MediaPoint as well. ATT did announce its completion of the Total Home DVR service rollout, on the day after 2wire introduced the media to MediaPoint.

But a check of the back of the boxes reveals that U-verse s 2wire gateways are geared for coaxial, while MediaPoint is something else : an extender for whatever the viewer s existing broadband connection may already be.

So if not ATT, then who provides the streaming media? With Netflix already taken , who s left? This morning, 2wire provided the answer, for all those who were playing at home but failed to buzz in: It s Blockbuster, which also announced the premiere of its long-awaited -- and, some analysts say, already too late -- on-demand streaming movie service, a direct competitor to Netflix.

The charter member s offer is compelling: When customers pre-purchase 25 streaming movie rentals from their Blockbuster Video retailer for a package deal of 99, they receive the MediaPoint box free. Thereafter, each rental is 1.99.

The true test, however, given how close it already is to the holiday season, will be the availability of MediaPoint devices through Blockbuster retailers. Distribution of devices, as many gamers know, has been a perennial problem for movie rental establishments. This morning, all 2wire and Blockbuster are saying is that they promise to begin shipping in time for the holiday season. Given current shipping schedules, you d think that would mean sometime last week.

Talks stalled over The Beatles on Apple s iTunes

Paul McCartney this week released a new album on to iTunes, and he wants the Beatles entire music back catalog to be up there, too. But will Apple Inc., Apple Corps, and EMI ever be able to just Let It Be?

Paul McCartney still wants The Beatles legendary rock tunes to be available on Apple s iTunes, but talks have reportedly gotten bogged down. After a trademark dispute of several decades between Apple Inc. and Apple Corps, negotiations are now going on between Apple and EMI, the Beatles former record label.

I really hope it will happen because I think it should, McCartney reportedly said, in an interview with the BBC.

Although music from individual Beatles members McCartney, Ringo Starr, and the late John Lennon and George Harrison is already sold on iTunes, The Beatles is now one of the few major acts to be absent from Apple Inc. s music site, with the exceptions of AC DC, Kid Rock, and country singer Garth Brooks.

In order to seal a deal with Apple Inc., however, EMI must secure an agreement with Apple Corps, the group set up to manage the Beatles record catalog, to make the back catalog available in digital form on iTunes.

Back in March of this year, reports in the British media said McCartney had agreed to make the entire Beatles song catalog available on iTunes, under a 400 million deal involving royalty payments to McCartney, Starr, the families of Lennon and Harrison, and possibly to rights holders Michael Jackson, EMI, and Sony Corp. as well.

Last year, Apple Inc. and Apple Corps reached final settlement of a legal battle which started back in 1978, when Apple Corps filed a trademark infringement lawsuit against Apple Computer. An initial settlement reached in 1981 made it difficult for Apple Computer to enter the music business later.

Times change, though. This year, Apple s iTunes claimed on several occasions to have become the most popular site on the Web for music downloads .

The Beatles music still isn t up there. But under the collective banner of The Fireman, McCartney this week launched a new, experimental album called Electric Arguments, which is now downloadable from Apple s site.

DHS proposes funky fix for RFID security

A proposal by the Department of Homeland Security attempts to address one potential security problem with RFID-chipped passports, but leaves more obvious problems hanging fire.

In an effort to detect attempts to clone the data stored on RFID chips used on US Passport Cards, DHS on Wednesday announced that it is recommending that manufacturers supplying these RFID chips include a unique identifier number, or Tag Identifier TID .

The TID would be used to ascertain when a chip s data has been cloned, as one would do to create a fake passport. If two passports with the same identifier number turned up at the border, one of them could be deduced as fake. That number would actually be the second unique number in the chip, since all a passport s RFID chip stores is a unique number that is indexed in a database. Currently the chips hold one unique number and one generic manufacturer code; that generic code is the one that would be replaced with a TID.

It s an identification model that works reasonably well with mobile phones and automobiles, but an identity document is a different creature. Conceivably, the ID number might help to determine whether, for instance, a hacker intercepting the snail mail has waved a reader near a State Department envelope and picked off the data without having to open the envelope -- with contactless technology, the envelope would not have to be opened. But the model may not help with other security issues RFID researchers, privacy activists, and anti-terrorism experts have flagged.

Some of their concerns apply to any common RFID-bearing item. For instance, since the chips themselves haven t much computational power, you can t do much to harden them from a security standpoint. Various cryptographic techniques have been advanced for hardening RFID chips, but those all cost money. The chips used in US passports are Electronic Product Code EPC Class One Generation Two chips, which operate in the 860-960 MHz band of the spectrum. Those cost about ten cents each, and are so non-hardened that observers have called them essentially wireless barcodes.

The numbers stored on an RFID are indexed a database on a presumably secure server, so by themselves, they wouldn t convey much information about the bearer. But simply knowing a chip s unique number can enable tracking of that chip s whereabouts. So if one keeps one s passport in one s possession at all times the way one s supposed to overseas, tracking the chip would mean tracking the passport holder.

But RFID-chipped passports may present a terrible attack surface simply by existing. RFID chips don t actively announce their presence, but inexpensive and widely available readers can sense them -- and can sense when there are a number of them gathered together.

One security professional who travels internationally and asked that he not be named suggests that if terrorists wanted to pinpoint the location of large groups of Americans a guided tour? a popular expat hangout? , the specific information on any one RFID chip would be far less useful than the simple ability to sense where a bunch of RFID chip carriers were grouped -- the very fact of their grouping may be information enough. Under those circumstances, grabbing the unique number s doesn t matter, since the specific ID data is unimportant; all that matters is the presence of the chips, and thus the targeted Americans.

Savvy owners of chipped passports or cards keep them in Faraday-cage wallets or sleeves. Faraday cages being what they are, not every kind of cage blocks every frequency, but the chips used in passports can be blocked fairly effectively...until you get to the TSA security checkpoint and your passport jacket sets off the metal detector.

It s unlikely that any scanning issues will be seriously addressed until DHS officials and security researchers can agree on what s possible with these chips. On the DHS site, the page explaining RFID chips claims that vicinity chips such as those used in travel documents can be read 20-30 feet away, while proximity chips must be just a few inches from the reader. The State Department, by the way, originally pushed for use of the relatively safer proximity chips; DHS however won the debate, and that s why your passport can be read by an official standing outside your vehicle.

However, those are generally minimum ranges, and variety of tests indicate that chips can be read at several multiples of that maximum distance. In fact, a paper released in late October by researchers at RSA and the University of Washington PDF available here found that the inexpensive chips used in US passports were readable at a whopping 50 meters.

MySpace and MTV s new revenue model challenges YouTube

In teaming up with MySpace this week, is MTV owner Viacom deviating all that much from YouTube around user uploads of TV show clips? Like YouTube partners CBS, EA, and Universal Music, Viacom now stands to make money from online ads.

After starting a highly controversial lawsuit against YouTube last year, and then getting smacked by a boycott from angry YouTube users last summer, MTV owner Viacom is now adopting a new approach to video content through a deal unveiled with the MySpace social network and tech start-up Auditude.

With Viacom and the Google-owned YouTube duking it out in court, News Corp. s MySpace had been trying until now to keep copyrighted materials -- including videos -- off of its social network.

But as the new deal with Viacom s MTV and Auditude gets under way, MySpace users will be able to upload segments from MTV shows such as The Hills and The Daily Show with Jon Stewart for viewing by others online.

Technology from Auditude will be used to detect the content to be aired online, as well as to tag it with an attribution layer. In addition to providing links for buying TV episodes, for instance, the attribution layer will give information to users such as the date a TV episode first aired.

Revenues from the video ads accompanying the uploaded MTV episodes will be be shared among MySpace, Auditude, and the video copyright holders.

But with the exception that content providers might get more control over which video appears online, the approach MySpace is now taking doesn t seem all that different from the strategy Google announced near the end of 2007, after being hit by a 1 billion lawsuit by Viacom in March of that year.

Viacom charged that YouTube did little or nothing to stop users from posting clips from Viacom-owned entities such as Comedy Central and Nickelodeon, mainly because those videos helped drive viewers to ads appearing on YouTube.

YouTube users then instigated a boycott against Viacom and its properties last summer, when as part of the legal proceedings, a federal judge ordered Google to turn over to Viacom a log containing the user login IDs and IP addresses of sources from which videos were downloaded, together with details about those videos.

YouTube users took the opportunity in July to consistently refresh a growing cache of anti-Viacom content on YouTube, with materials that included new videos exhorting people to band together in a boycott covering Viacom s Web site, MTV cable networks, Paramount films including the Indiana Jones film that premiered in May , and other Viacom-owned properties.

Under the strategy announced by YouTube after Viacom filed its suit, YouTube is supposedly first identifying video clips and then giving holders of the copyrights a choice between either 1 having the video taken down or 2 allowing YouTube to place ads on it in exchange for a chunk of the revenue. Then last month, YouTube started adding click-to-buy links for products -- like songs, books, and movies -- related to the content from partners that s available for viewing on the YouTube site.

YouTube s participating content owners in the plan include CBS Corp., Electronic Arts EA Inc., and Universal Music.

Apple s iPod chief steps down, iPhone sales outlook follows suit

Senior Vice President of Apple s iPod division, Tony Fadell has stepped down from his leadership position, and is being replaced by former IBM exec Mark Papermaster.

Fadell is regarded as the progenitor of the iPod ecosystem, bringing to Apple in 2001 the idea of a portable media player with its own dedicated online marketplace. Though The Wall Street Journal says he will be keeping a consultancy position, Fadell s Apple Bio has been removed .

Fadell s replacement, Mark Papermaster, was an architect of the PowerPC 630 chip in the 90s, and later was put in charge of the blade server division. IBM reportedly sued Papermaster for violating his agreement with the company by taking up employment with Apple.

As the departure of a portable device guru is greeted with the arrival of a chip design and server guru, the Mac rumor mill has begun to churn out speculation about the future of the iPod, the device responsible for Apple s current strength.

Meanwhile, the future of the iPhone looks to hold decreased production. This week, Apple reportedly cut its calendar fourth quarter outlook for iPhone production. Analyst Craig Berger said production of the device could drop as much as 40 from the last quarter, with even more coming in the following quarter. It is uncertain that this reduction is a scaling back of a previously increased production rate or the sign of decreasing demand.

DivX Connected gets vital upgrade: Flash

The DivX Connected platform has received a couple of crucial upgrades, making the hardware-software hybrid system more attractive to open source developers and consumers alike.

Version 1.4 of the DivX Connected server has been released, finally granting the home server software Flash Support, and adding to its unique Wake-on-LAN tools. With the server upgrade, a host of associated plug-ins were also released, bringing the platform into a place where it is equally desirable to casual consumers as it is to the maker crowd.

Flash support has finally given DivX Connected users access to YouTube, Hulu, ABC News, DailyMotion, CollegeHumor, Vimeo, and so many other Flash-based video sites that form the backbone of online video today. DivX s Bruce Lidl says, From now on, it s the whole world of dogs on skateboards, fully consumable from your sofa.

Similar to TiVo s unique YouTube interface , these plug-ins tailor video sites to the DivX Connected remote control scheme. On a standard definition television, the Hulu and Vimeo plug-ins are highly watchable.

Wake-On-LAN functionality grants users with DivX Connected hardware such as the D-Link DSM-330 the ability to remotely turn their media servers on and off via the client, regardless of physical location.

The DivX Connected system has matured tremendously, but still is best suited as a Second TV solution. From the perspective of a user, I ve grown to look at the DSM-330 as the Apple TV of free content, and the addition of Flash support just opens the box even further to that world. However, the unique wake-on-LAN features -- and the potential exploitation of that feature -- give it an added boost in desirability.

While its offerings are far from comprehensive entertainment solutions, like those provided by video game consoles or TiVo, developers are given a lot to play with. The latest upgrades give devs access to Tile and Film Strip control, allowing nested column-based or cover flow style UIs to be built, complete with perspective and reflection elements. The Gecko engine which the system is built upon -- the same that powers Firefox 3 -- has also been upgraded. Most importantly, of course, Flash support now avails the giant amount of Web content heretofore off-limits to the platform.

Pandora sees relief ahead in net radio fee talks

Pandora s Tim Westergren says he s more optimistic than ever before that his webcasting service won t be yanked offstage, as the House passed a bill letting net radio stations extend royalty rate negotiations with labels and artists.

The Webcaster Settlement Act of 2008 would give Congressional blessing for SoundExchange, the music industry s collection service, to work directly with the Digital Media Association, which represents online services such as Pandora, as worked out by an industry agreement last week . The permission to negotiate rates would circumvent rate levels set in 2007 by the Copyright Review Board.

Those rates would have, by 2010, demanded performer royalties totaling as much as 70 percent of station revenues, far exceeding those paid by satellite radio or by over-the-air AM FM radio -- which, for the record, pays no performance royalties at all.

That royalty gap -- which dates back decades -- has been the elephant in the room in the long-running negotiations, Westergren tells BetaNews. Back in the 1930s and 1940s, composers -- not singers or musicians -- had most of the bargaining power when it came to negotiating fees for broadcast-radio play. To this day songwriters get royalties for radio play of their songs while performers console themselves, or don t , with the record-selling publicity that airplay provides. But as music styles changed and performers rose in importance, they were able to push for greater parity with songwriters, not to mention more lucrative deals with satellite radio and, now, webcasters.

Westergren, a performer himself, says that webcasters aren t seeking a return to AM FM non -pay rates; they re not fair. But stratospheric rates for Webcasters are even less fair in light of net radio s proven ability to sell records. Once again getting played has promotional benefit -- and the irony is there s not a performer alive that wouldn t want to be played -- but online, the promotion of playing an irresistible song is powered by the rocket fuel of instant online-shopping gratification.

Pandora has gathered a great deal of data on how its 16 million users shop, and Westergren says that those studies show that online listeners are most definitely bigger music buyers.

The industry right now is wrestling with, What is a sale? -- whether that s 99-cent singles, or CDs, or whatever. As the retail impact of Net radio becomes better known, says Westergren, I hope the RIAA will start to be able to recognize a friend. He says that Pandora has offered to pay for additional studies showing the impact of net radio play on sales, but the company s offers have been RIAA-rebuffed.

The Recording Industry Association of America has had a famously unfriendly relationship in general with music on the Internet. The perception of RIAA is that interactivity equals cannibalism, says Westergren, whose service is more interactive and less like traditional radio than one such as competitors Live365 or Shoutcast. But the only thing that should matter is data around purchase habits.

He acknowledges that changes to the system, however overdue as law catches up to the technology, will continue once all sides have entered into the period of reconciliation he sees ahead. The music business is a schizophrenic industry -- there are wild extremes, there s a tremendous amount of internal debate about how to proceed online. But webcasters have been at this long enough that some strategies are either bearing fruit, or they re futile.

And though the gap between the law and technology may have strained the nerves of both principal players and the tens of thousands of net radio fans who hit the phones whenever Pandora and other stations were threatened, Westergren s quick to say that artists and consumers should be thanking the government for dragging all parties to the negotiating table once again.

Rep. Jay Inslee D - Wash. , long a presence in the net radio debates, sponsored the current bill, officially known as HR 7084; the four co-sponsors are Reps. Howard Berman D - Calif. , John Conyers D - Mich. , Donald Manzullo R - Ill. and Lamar Smith R - Tex. . Westergren also cited the support of Sam Brownback R - Kan. and Ron Wyden D - Ore. , who sponsored the Radio Equality Act of 2007. That legislation was widely credited with dragging the RIAA-radio tussle over fees back from the edge of the abyss last year.

US gov't cannot use cell phone IDs without a warrant, court affirms

How much does your cell phone say about who you are and where you are? Last year, the US government wanted the authority to use the information cell phones put out naturally in its own investigations. Yesterday, a judge said no.

Pennsylvania US district court judge Terrence McVerry late yesterday denied the US government's appeal of a federal magistrate's order last February, that effectively prohibited the government from acquiring location information from individuals' cell phone location tracking devices without a warrant.



Last February, a five-judge panel of magistrates denied a government petition that would have enabled it to use live data generated from cell phones to track the locations of suspects, without a court order. Specifically, the government wanted to use the Stored Communications Act as a basis for requesting cellular service providers for information about a suspect's whereabouts. In its argument, the government stated that its agents determine suspects' whereabouts through clandestine visual tracking already, without court order, and that clandestine electronic tracking would not be very different.

In essence, the government argued, a suspect does not have the Constitutional right to his or her own location. The magistrates considered whether any such tracking would constitute a violation of citizens' rights under the Fourth Amendment of the Constitution.

Writing on behalf of the panel last February, Judge Lisa Pupo Lenihan noted that there's no doubt that the government may be entitled to such information in the course of its investigation. However, the judge continued, the standard which must be met for proving probable cause in court, is not unreasonably high.

"The issue is not whether the Government can obtain movement/location information, but only the standard it must meet to obtain a Court Order for such disclosure and the basis of authority," Judge Lenihan wrote in February (PDF available here , courtesy Judicial Review). "It emphasizes that the Fourth Amendment standard is not a difficult one, requiring only that the Government support its belief of criminal activity and the probable materiality of the information to be obtained.

"The Court notes that it is entrusted with the protection of the individual civil liberties, including rights of privacy and rights of free association, so paramount to the maintenance of our democracy," the judge continued, on behalf of the magistrates' panel. "The Court also observes that the location information so broadly sought is extraordinarily personal and potentially sensitive; and that the ex parte nature of the proceedings, the comparatively low cost to the Government of the information requested, and the undetectable nature of a [cellular service provider's] electronic transfer of such information, render these requests particularly vulnerable to abuse."

Lenihan went on to say that most Americans aren't really aware of how much location information their cell phones are capable of divulging, adding "most Americans would be appalled by the notion that the Government could obtain such a record without at least a neutral, judicial determination of probable cause."

Essentially affirming the panel's conclusions yesterday, Judge McVerry merely stated that he carefully considered amicus briefs filed in opposition to the government's request, including from the American Civil Liberties Union, and used their arguments to conclude Judge Lenihan's order "is not clearly erroneous or contrary to law."

Google drops Bluetooth and GTalk APIs from Android SDK 0.9

In a blog post yesterday, a Google developer advocate detailed just why the latest SDK for the emerging Android phone OS isn't exactly the same as Google first intended -- in other words, why Bluetooth and GTalk are missing.

Why didn't Google's Android SDK version 0.9, released into beta earlier this week, include originally planned APIs for Bluetooth and Google's own P2P-enabled GTalkService? According to Dan Morrill, a Google developer advocate, Google drew the conclusion that neither its Bluetooth API nor the GTalkService would be ready for prime time prior to the final release of the SDK for the first Android phones.



As things now stand, the Android SDK will, in fact, support Bluetooth wireless headsets, Morrill maintained, in a post to the Android Developers Blog on Tuesday. In an earlier edition of the pre-release software, however, the SDK also included an incomplete draft of an API that would have exposed underlying Bluetooth functionality to Android developers. "Unfortunately, we had to remove that API from the 1.0 release," Morrill wrote.

Morrill also quoted Nick Pelly, one of the engineers responsible for the Bluetooth API functionality, as saying, "The reason is that we plain ran out of time. The Android Bluetooth API was pretty far along, but needs some clean-up before we can commit to it for the SDK. Keep in mind that putting it in the 1.0 SDK would have locked us into that API for years to come."

Google, though, is not abandoning its intentions for a Bluetooth API. "We absolutely intend to support a Bluetooth API in a future release, although we don't know exactly when that will be," Morrill contended.

As for GTalk, the service still has some security problems that need to be ironed out, according to Morrill. He cited Rich Canning, one of Google's security researchers, as noting that, as it was first designed, GTalkService placed too much of a security burden on developers to avoid security flaws and to perform user and relationship management.

"An Android application using GTalkService would be reachable from all of the user's Google Talk friends, and a flaw in that application could pose an inviting target to a malicious 'friend' or automated malware. There are automated mechanisms that could be used to help protect vulnerable applications or stop the spread of malware, but the deployment of these technologies was not possible in time for the launch of the first Android handsets," Canning elaborated.

Morrill didn't promise that the Android SDK will ever support this service, and he pointed out that, in any event, "it was never guaranteed that [GTalkService] would be present on every Android device."

Yet one of Google's top priorities after the first Android devices ship is to "develop a device-to-device (and possibly device-to-server) RPC mechanism that is fast, reliable, and protective of developers and users alike," according to Morrill.

Worldwide iPhone 3G problems may lie with the network

Although Apple's iPhone 3G is getting some plaudits in the world press, people are also complaining about wireless connectivity speeds, price, and other issues, depending in part on where they live.

In the US, iPhone 3G users with AT&T have reported average download speeds of about 990 Kbps, the same as for Softbank in Japan and Telia in Sweden. Canadian carrier Rogers Communications did much better with an average download speed of about 1,330 Kbps.



But users in many other countries continued to experience a range of different connection speeds, a phenomenon that Wired magazine attributed more to operators' networks than to the iPhone.

In an informal survey conducted by Wired , users in Germany and the Netherlands reported the fastest 3G download speeds -- of roughly 2,000 Kbps -- while users in Australia reported the slowest: about 759 Kbps.

Yet in San Francisco, 10 out of 30 participants reported speeds about equivalent to EDGE. The report theorized that, in major metro areas, 3G towers are getting overloaded. Also, US participants accounted for about 75% of zero data results, suggesting that many of them were dropped from AT&T's 3G network during speed tests.

Meanwhile, reports from French publications indicate that, in that country, wireless operator Orange might be artificially throttling iPhone 3G speeds.

Customers of Orange have been reporting download speeds as low as 350 to 450 Kbps. Yet the phone has shown itself to be capable of achieving much higher speeds when connected to other European networks, such as SFR in France, according to an account in iPhoneAtlas.

In Latin America, Telefonica last week launched the new phone in eight nations, and American Movil in ten. "Argentina, Uruguay and El Salvador have Latin America's highest wireless penetration rates, so products like the iPhone will help operators get new business from existing clients," according to an account in Latin Business Chronicle .

"However, despite the buzz around the iPhone specifically and 3G services in general, it will only be with a massive distribution of affordable third-generation phones that the 3G market will start taking off in Latin America, experts say. And that may not happen until 2010."

In India, where pricing now starts at $712 for an 8 GB model, other types of complaints are surfacing.

Indian wireless operator Airtel held a launch event at a local shopping mall last week and only "managed to sell over 25 pieces of the glorified mobile phone," says a report in iExpressIndia.

The Indian publication also quotes one user -- a high-tech marketing executive -- as saying that, "The cost of the phone is too high and, moreover, the phone is poor -- pretty low in features."

As the user then elaborated: "The first generation iPhone and the iPods have full metal bodies, but the second generation iPhone that has been launched in India has a plastic body and is prone to cracks and scratches. The battery life is low."

In the Philippines, a reviewer was impressed with certain features of the new phone, such as the Safari browser and the quality of video and audio playback. But he was not enthralled by the new phone's lack of a replaceable battery.

"Ah, this one is a big issue considering that the new iPhone has a 3G radio and GPS. The battery would last for a day but anything more than that is a miracle -- unless you turn off everything from Wi-Fi [to] Bluetooth, GPS [and] 3G," he wrote in the Manila Bulletin Online.

In its latest Stop||Watch commercial rankings , TiVo found that, while viewers fast-forward through most paid advertisements, movie trailers are among the least skipped.

Stop||Watch has been measuring this trend for months. In May, the top three most-watched commercials were promoting movies. Now, the results for June show the top four commercials in total viewing were for movies.



Commercials for Sony Pictures' Hancock with Will Smith ranked as the most viewed altogether, followed by spots for Universal's The Incredible Hulk, Warner Brothers' The Dark Knight, and 20th Century Fox's The Happening. Disney's Wall-E was in sixth place behind a Nike ad.

Astute advertisers have already exhibited their firm grasp of the power of movie trailers this year. Sprint's and Samsung's Instinct smartphone was backed by "The Ultimate Product Placement" movie trailer ad campaign. Perhaps not so coincidentally, The Instinct became Best Buy's top selling handset over the past two years. And two months ago, LG's movie-trailer-style campaign for its 'Scarlet' HDTVs was so convincing -- complete with a real actress in the "starring role" -- that some viewers were actually left wondering when the movie would premiere.

Also, as TiVo revealed today, Stop||Watch research data has found that viewers are more likely to fast-forward through broadcast network commercials than those aired on cable networks. 60% of ads aired on Fox during prime time, for example, are skipped; while only 22% of ads on ESPN were skipped during prime time. Cable networks, however, have only a fraction of the viewers of broadcast networks.

Sirius XM disputes negative interpretation of its CEO's comments

Following a BetaNews article indicating that Sirius XM CEO Mel Karmazin suggested the company's finances were in bad shape, the company shot back that it was not the case.

A spokesperson for the satellite radio provider contacted BetaNews late Tuesday refuting the original article's premise that Karmazin had admitted that Sirius XM's finances were not healthy.



"There was certainly no place where Mel 'admits' to the company in bad financial shape. Simply not true nor said," Sirius SVP for Communications Patrick Reilly told BetaNews.

Sirius XM did not deny that the company's CEO did say that the terms of the debt refinancing accepted by Karmazin were unfavorable to the company. In order to complete the transaction, over a half-billion dollars was refinanced at the last minute to complete the $2.76 billion transaction.

In his note to BetaNews, Reilly pointed to the fact that Sirius was able to increase revenues in the most recent quarter, as well as growing its total subscriber base by 25 percent. Two weeks ago, Sirius posted revenues of $283 million on 8.9 million subscribers.

He also argued that Sirius' position in the industry is strong, and it is among the fastest growing subscription media businesses. Additionally, the company's costs to acquire customers decreased, and it was able to keep its cash expenses essentially flat.

But Reilly's major point of contention was not so much with the body of our story as with the headline, "CEO Mel Karmazin admits Sirius XM is in bad financial shape." "We would like your headline to more accurately portray what [the] Bloomberg story said and the reality of our recent publicly announced results," he wrote.

While a further review of the original story, along with the Bloomberg News story that triggered it , may indicate that in this particular case Karmazin did not explicitly admit to problems with the company's finances, other recently uncovered comments -- including some on Bloomberg's television network -- and further research suggest otherwise.

For example, take a look at both merger partners' balance sheets. XM's final independent quarterly report is here , while Sirius' most recent report for its fiscal Q3 is here . On July 22, XM -- which was responsible for the additional debt that Sirius may have not initially seen, according to Karmazin -- explained that its debts were primarily a factor of subscriber acquisition costs (SAC).

Simply put, subscriber acquisition costs are the subsidies a satellite broadcaster pays for the marketing and production of its radios. These fees include subsidies to automakers and CE manufacturers, as well as incentives related to marketing these devices and the like. It could be argued that XM was just spending too much money to sign on new customers.

Essentially, during its due diligence, XM may have forgotten to compound the total deficits that came with attempting to grow its total customer base, ending up with over a billion dollars more in debt than it initially indicated it had.

Sirius is suffering from the same problem. By taking on XM's SAC-related debt, it has only compounded the issue.

CEO Karmazin is obviously not ignorant to this. In fact, in the portion of his interview that appeared on Bloomberg TV, when asked about the company's financial situation, Karmazin does admit there are issues. In a segment cited by BloggingStocks , the CEO said, "We need to get the revenue up beyond the cost of operating our business."

That's been the problem with satellite radio all along. In its most recent quarter, Sirius posted a net loss of $83.9 million, while XM posted a net loss of $120 million for its final Q2. While both have cut losses significantly over a year ago -- in the case of Sirius, by some 37% -- they are still considerable by any means.

Lending weight to the case against Sirius XM's claims of purely positive financial health, is its current stock price. Now trading under Sirius' old ticker symbol SIRI, its stock value is down 50% since the beginning of the year, and over 60% from its 52-week high in late November 2007.

What these various factors add up to is a much weaker financial picture for the combined company, as opposed to when XM and Sirius first announced their merger plans over a year and a half ago.

Auto dealer software company slashes '08 outlook

LAKE SUCCESS, N.Y. - Automotive dealer software manufacturer DealerTrack Holdings Inc. slashed its full-year earnings and revenue projections Monday, saying a challenging credit environment and slowdown in new car sales would impede performance.

Its shares tumbled 16 percent in after-hours trading, shedding $2.54 to $13.25 after closing the regular session down 21 cents at $15.79.

The Lake Success-based company said it expects to earn between $9.4 million and $12.8 million in 2008. That would be earnings per share of between 22 cents and 30 cents.

The company previously expected to earn between $21 million and $22.6 million, or 48 cents to 52 cents per share.

DealerTrack executives said they expected revenue of $246 million to $253 million — down from earlier estimates of $268 million to 272 million.

Analysts surveyed by Thomson Financial expect the company to earn 98 cents per share on revenue of $260 million for the year.

"We continue to expand our product offerings and to invest in our existing products," DealerTrack Chairman and Chief Executive Mark O'Neil said in a statement. "We believe we can continue to grow through this economic downturn. It would be shortsighted of us to stop development of new projects; instead, we remain focused on growing DealerTrack by providing our customers with the solutions they need to be more efficient."

The company said its new outlook doesn't assume a recovery in the nation's auto lending environment this year.

Separately Monday, DealerTrack said its second-quarter profit fell 51 percent to $3.06 million, or 7 cents per share, in the quarter ending June 30. That's down from $6.28 million, or 15 cents a share, during the same period last year.

Attacks continue on Russian and Georgian Web sites, but who's to blame?

Armed conflict between Russia and Georgia has been paralleled by what many in the media have classed a "cyberwar," where Georgian Web sites have been crippled by DDoS attacks and defacements.

As Georgian government sites were rendered inaccessible this week, Poland, Estonia, and the United States hosted mirrors to provide supplementary outlets for information. Polish president Lech Kaczynski's official site says, "Along with military aggression, the Russian Federation is blocking Georgian Internet portals."



Though the attacks were traced to servers in both Russia and Turkey, the Russian government has denied involvement in the action, citing several of its own Web services that have also succumbed to DDoS attacks.

The denial of service attacks against Georgia bear a remarkable similarity to those that took place against Estonia in 2007. These attacks, due to their scope, were also suspected to have been orchestrated by the Russian government, but no evidence could be provided to substantiate any accusations.

In July, 300 Lithuanian sites were compromised and defaced by pro-Russian hackers in response to the Lithuanian ban on Soviet symbols, such as the hammer and sickle of the old Communist Party. This act was preceded by appeals on Russian forums, according to The Baltic Course , that called for hackers to unite against Baltic countries Estonia, Latvia, and Lithuania as well as Ukraine.

"All the hackers of the country have decided to unite, to counter the impudent actions of Western superpowers. We are fed up with NATO's encroachment on our motherland, we have had enough of Ukrainian politicians who have forgotten their nation and only think about their own interests. And we are fed up with Estonian government institutions that blatantly re-write history and support fascism," the message stated.

Those attacks, according to Lithuanian security researchers, came from compromised French and Swedish hosts.

The Estonian cyberattacks in 2007 and the current ones against Georgia are now regarded as the two of the biggest organized service attacks in history. Unfortunately, no firm evidence has been presented that implicates any single organization in either action.
